基于建设项目污染全过程管控的行业环境准入指引构建及应用研究

  • 摘要: 生态环境分区管控制度确立以来,我国污染源头预防体系的宏观管控进一步强化,同时分区管控与环评、排污许可等制度之间叠床架屋问题日益凸显。在环境治理体系和治理能力现代化的语境下,引导企业主动落实环保要求的环境准入指引,成为强化宏观管理、简化微观管理重要手段之一。本文采用系统对比分析的方法,比较了环境准入指引与环境准入的异同点,剖析了的环境准入指引功能定位,及其非强制性引导规则、项目全过程污染防控引导等内涵属性。研究构建了源头预防、过程管控、事后监管的三维度指标体系,及“三维目标需求—差异化指引内容—多样化指引方式—多维应用场景”的环境准入指引应用的整体框架体系,为环境准入指引构建提供了理论和方法指导。并在长三角某园区汽车制造行业(C36)开展示范应用,结果表明,环境准入指引指标体系及应用体系,有效指导了该行业建设项目事前事中事后污染防控,为3个试点豁免环评建设项目选址、生产过程落实环保要求及事后环保部门监管提供了清晰的指引,发挥了项目环评“强措施、控风险” 的功能,为筑牢污染防控底线提供了有力支撑。

     

    Abstract: Since the establishment of the ecological environment zoning and control system, China's macro-level management of pollution source prevention has been further strengthened, while the issue of overlapping regulations between zoning controls and systems such as environmental impact assessments and pollutant discharge permits has become increasingly prominent. Under the context of modernizing the environmental governance system and capabilities, environmental access guidelines that guide enterprises to proactively comply with environmental requirements have emerged as a key tool for strengthening macro-management and simplifying micro-management.  This study employs a systematic comparative analysis approach to examine the similarities and differences between environmental access guidelines and environmental access. It analyzes the functional positioning of environmental access guidelines, as well as their non-mandatory guidance rules and project-wide pollution prevention and control guidance. The research establishes a three-dimensional indicator system encompassing source prevention, process control, and post-event supervision, along with an overall framework for environmental access guidelines application—"three-dimensional objectives and needs—diverse guideline content—varied guidance methods—multi-dimensional application scenarios." This provides theoretical and methodological guidance for constructing environmental access guidelines.  Demonstration applications were conducted in the automotive manufacturing industry (C36) within a pilot park in the Yangtze River Delta region. Results indicate that the environmental access guidelines and application system effectively guided pollution prevention and control for construction projects in the industry before, during, and after implementation. They provided clear direction for the site selection of three pilot exempted environmental impact assessment projects, the implementation of environmental requirements during production processes, and post-event supervision by environmental authorities. The guidelines fulfilled the function of "strong measures and risk control" in project environmental assessments, offering robust support for safeguarding pollution prevention and control.
